These Terms of Service (“Terms”) govern your access to and use of the VineChart website, applications, APIs, and related services (collectively, the “Services”) operated by VineChart (“we,” “us,” or “our”). By using the Services or purchasing a subscription, you agree to these Terms. If you do not agree, do not use the Services.
Summary: Free email alerts and paid SMS Vine Drop Alerts are separate. Paid SMS is billed through Stripe on a recurring monthly basis at the price shown at checkout. We do not offer refunds except where required by law. Text STOP to end SMS and cancel billing immediately; canceling in Manage / the Stripe Billing Portal usually ends SMS at the end of the paid period. Alerts depend on third parties (carriers, networks, payment processors); we do not guarantee delivery. For questions, use our contact form or email support@vinechart.com.
You must be at least 18 years old and capable of forming a binding contract in the United States. The paid SMS program is intended for United States mobile numbers only. You agree that the information you provide (including email, phone number, and payment details) is accurate and kept up to date, and that you are the owner of (or authorized user of) the phone number you enroll.
You are responsible for safeguarding any credentials or one-time codes we provide and for all activity under your subscription or contact information. Notify us promptly through the contact form if you suspect unauthorized access or charges.
VineChart provides tools and information related to Amazon Vine activity, including optional notifications. Free email notifications (where offered) are separate from the paid SMS subscription. Features, availability, and pricing may change; we will provide notice where required by law or as described at checkout.
VineChart is not affiliated with Amazon. We do not guarantee Vine enrollment, product availability, drop timing, or any Amazon Vine program outcome.
The paid SMS Vine Drop Alerts feature requires a recurring subscription processed by our payment processor (Stripe, Inc.). Checkout is hosted by Stripe. By completing checkout, you authorize Stripe to charge your payment method on a recurring basis for the amount and billing interval shown at checkout (currently billed monthly in USD unless we state otherwise) until you cancel in accordance with these Terms.
You may cancel the paid SMS subscription in any of the following ways:
Important: Canceling billing in the portal (end of period) and texting STOP (immediate SMS opt-out + immediate cancel under our current rules) are different. If you cancel only in the portal, you may still receive texts until the period ends unless you also reply STOP. If you reply STOP, SMS stops and billing is canceled immediately as described above.
If a payment fails, Stripe may retry the charge according to its rules and our configuration. While a subscription is past due or otherwise not in good standing, we may suspend SMS alerts and other subscription benefits until payment succeeds. After repeated failures, the subscription may be canceled. Resuming alerts may require bringing the subscription current and, if you previously opted out of SMS, re-consenting (for example by completing checkout again and/or texting START where we instruct you to do so).
All fees are non-refundable, except where required by law or at our sole discretion. This includes unused time in a billing period after cancellation or STOP. Chargebacks and payment disputes may result in suspension or termination of access.
This section applies if you enroll in VineChart Vine Drop Alerts (paid SMS). By checking the consent box(es) at signup and completing checkout, you expressly consent to receive automated text messages from or on behalf of VineChart at the US mobile number you provide. Consent is not a condition of purchasing any other VineChart product where we offer alternatives (such as free email alerts, where available).
You agree not to misuse the Services, including: attempting unauthorized access, interfering with the Services, violating applicable law (including telemarketing and consumer-protection laws), harassing others, providing a phone number you do not control, or using automated means to access the Services in violation of our rules or robots restrictions we post.
VineChart names, logos, branding, software, and content are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial use unless otherwise agreed in writing.
The Services rely on third parties, including Stripe (payments and billing portal), SMS delivery providers (currently Telnyx or a successor carrier-approved messaging platform), email delivery providers, Cloudflare, and mobile carriers. Their terms and privacy practices may also apply. We are not responsible for third-party failures outside our reasonable control.
THE SERVICES AND NOTIFICATIONS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
Information and alerts may be delayed, incomplete, or incorrect. VineChart is not affiliated with Amazon; VineChart does not guarantee enrollment, product availability, or Vine program outcomes.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL—INCLUDING DAMAGES ARISING FROM MISSED, LATE, OR FAILED ALERTS OR PAYMENTS.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES IS LIMITED TO THE GREATER OF USD $100 OR THE TOTAL AMOUNT YOU PAID US FOR THE SUBSCRIPTION IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
You will defend and indemnify VineChart and its operators against claims arising from your misuse of the Services, your violation of these Terms, or your violation of others’ rights, to the extent permitted by law.
We may suspend or terminate access to the Services (including SMS) for conduct that violates these Terms, creates risk, involves non-payment, suspected fraud, regulatory requirements, or as required to comply with law. We may also discontinue the SMS program with reasonable notice where practicable.
These Terms are governed by the laws of the State of Missouri and the United States of America, without regard to conflict-of-law principles. You agree that exclusive jurisdiction for disputes will be in the state and federal courts located in Missouri, except that either party may seek injunctive relief in any court of competent jurisdiction.
We may update these Terms by posting a revised version on this page and updating the “Last updated” date. If changes are material, we will provide additional notice where required (including email for subscription changes where applicable). Continued use after the effective date constitutes acceptance of the updated Terms where permitted by law.
